WTO紛争解決機関（DSB）の勧告を受け（参照）、1998年6月、バナナ市場規則は改正されているが（発効は1999年元旦）、その前文では次のように規定されている。
… the Community's international commitments under the [WTO] and to the other signatories of the Fourth ACP-EC Convention should be met, whilst achieving at the same time the purposes of the [COM for bananas];
1998年のバナナ市場規則の内容については こちら なお、1998年のバナナ市場規則もWTO法に違反することがDSBによって確認されたため（1999年5月のDSB報告書）、2001年1月、EU理事会は、再度、市場規則を改正している。
