Article 47 Right to an effective remedy and to a fair trial

Everyone whose rights and freedoms guaranteed by the law of the Union are violated has the right to an effective remedy before a tribunal in compliance with the conditions laid down in this Article.

Everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal previously established by law. Everyone shall have the possibility of being advised, defended and represented.

Legal aid shall be made available to those who lack sufficient resources insofar as such aid is necessary to ensure effective access to justice.

 



第47条 実効的な法的救済と公平な裁判を受ける権利


はじめに

 第47条は適正な裁判を受ける権利を全ての者に保障しているが、欧州人権条約第6条 および 第13条 や従来のEC裁判所判決を基に起草された。特に、EC裁判所は実効的な法的救済の必要性を度々、強調しており、第47条の解釈・適用に際し、この判例法を参照する必要がある。なお、EUだけではなく、(EU法の実施にかかる場合には)加盟国もこの権利の保障が義務付けられる。これは、例えば、第41条がECに対する権利保護についてのみ定めている点で重要である。裁判所はEC裁判所であるか、または国内裁判所であるかを問わない。

 

規定の内容

(1)第1項(実効的な司法救済を受ける権利)

 第1項は、実効的な司法救済を受ける権利を全ての者に保障しているが、訴えの理由は、EU法上の権利ないし自由が侵害されることである。つまり、国内法で保障された権利・自由が侵害される場合、第1項は適用されない。

 侵害者は、EUの諸機関であっても、加盟国であってもよい。特に、第41条第2項 が定める権利(行政機関の審問を受ける権利など)は、EUの機関に対してのみ主張しうるため、第47条第1項が加盟国の行為に対しても、実効的な司法救済を保障している点は重要である。なお、加盟国の行為について、基本権憲章は、EU法の実施に関するものにのみ適用されるため(第51条第1項)、純粋な国内法の適用によって権利・自由が侵害される場合には、第47条第1項は適用されない。

 提訴しうる裁判所は特定されていないが、EU・ECの諸機関によって、上掲の法益が侵害される場合はEC裁判所(厳密には、第1審裁判所ないし司法小委員会〔EC条約第230条第4項参照〕)、また、加盟国によって侵害される場合は国内裁判所となる。なお、国内裁判所がEC裁判所に先行判断を求める場合は(第234条参照)、EC裁判所に訴えが係属する。加盟国によって侵害される権利・自由が欧州人権条約によっても保障されている場合には、欧州人権裁判所への提訴も認められる。これに対し、EU・ECはまだ同条約を締結していないため、EU・ECによる権利侵害に際しては、欧州人権裁判所に救済を求めることはできない。

 実効的な司法救済を受ける権利は、欧州人権条約第13条を基にしているが、同規定が裁判所による救済に限定せず、行政機関による救済をも包含している点で異なる。なお、この権利は、すでにEC裁判所の判例法において、EC法上の重要な原則として確立しているため(Case 228/84, Johnston [1986] ECR 1651, para. 18; Case 222/86, Unectef [1987] ECR 4097, para. 14; Case C-97/91, Oleficio Borelli [1992] ECR I-6313, paras. 13 et seq.)(詳しくは こちら)、欧州人権条約第13条を引き合いに出すまでもない。司法救済が実効的であるかどうかの判断については、従来のEC裁判所の判例法が解釈の基準となる。
 


(2)第2項(裁判を受ける権利)

 第2項第1文は、全ての者に対し裁判を受ける権利を保障しているが、裁判所は、@独立、公平、かつ、すでに法律に基づき設置され、A公正な手続に従い、B公開され、また、C適切な期間内に事件を扱わなければならない。これは欧州人権条約第6条第1項に相当するが、同規定は市民法上の権利や義務(civil rights and obligations/droits et obligations de caractère civil)の確定や刑罰の決定に際してのみ、裁判を受ける権利を保障しているのに対し、憲章第47条第2項は、そのような制限を設けていない。もっとも、欧州人権裁判所は、市民権や義務を広く捉え、単なる民事上の権利・義務に限定していないこと、また、憲章第51条第1項より、憲章の適用範囲はEU法が実施される場合に限定されるため(つまり、刑罰の決定は除外される)、憲章第47条第2項と人権条約第6条第1項の保障範囲は実質的に異ならない。

 第2項第2文は、第3者から(法的)助言や弁護を受け、また、第3者に代理させる権利を保障している。刑事訴訟については、この権利は第48条第2項によって補充される。なお、弁護士代理の原則は導入されなかったため、加盟国は弁護士以外の者による代理を認めることも可能である。
 


 (3) 第3項(手続費用扶助)

 裁判所へのアクセスを実効的に保障するため、第3項は、手続費用を助成する必要性について定めている。なお、欧州人権裁判所は、必要であるにもかかわらず、手続費用が助成されないときは、実効的な救済を受ける権利が適切に保障されていないとの判断を下している(Case Airey v. Ireland, Serie A, vol. 32, p. 11)。

Article 6 (1) of the ECHR

In the determination of his civil rights and obligations or of any criminal charge against him, everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law. Judgment shall be pronounced publicly but the press and public may be excluded from all or part of the trial in the interests of morals, public order or national security in a democratic society, where the interests of juveniles or the protection of the private life of the parties so require, or to the extent strictly necessary in the opinion of the court in special circumstances where publicity would prejudice the interests of justice.



Article 13 of the ECHR
Everyone whose rights and freedoms as set forth in this Convention are violated shall have an effective remedy before a national authority notwithstanding that the violation has been committed by persons acting in an official capacity.

 

Article 51 Scope
1. The provisions of this Charter are addressed to the institutions and bodies of the Union with due regard for the principle of subsidiarity and to the Member States only when they are implementing Union law. They shall therefore respect the rights, observe the principles and promote the application thereof in accordance with their respective powers.


2. This Charter does not establish any new power or task for the Community or the Union, or modify powers and tasks defined by the Treaties.

 

 

Article 52 Scope of guaranteed rights


1. Any limitation on the exercise of the rights and freedoms recognised by this Charter must be provided for by law and respect the essence of those rights and freedoms. Subject to the principle of proportionality, limitations may be made only if they are necessary and genuinely meet objectives of general interest recognised by the Union or the need to protect the rights and freedoms of others.
 

2. Rights recognised by this Charter which are based on the Community Treaties or the Treaty on European Union shall be exercised under the conditions and within the limits defined by those Treaties.
 

3. In so far as this Charter contains rights which correspond to rights guaranteed by the Convention for the Protection of Human Rights and Fundamental Freedoms, the meaning and scope of those rights shall be the same as those laid down by the said Convention.
This provision shall not prevent Union law providing more extensive protection.
